CampusCloud Terms of Use

Welcome to CampusCloud, a digital marketplace for student-developed apps and services. This document outlines the legal terms and conditions that govern your use of the CampusCloud platform. By accessing or using CampusCloud, you agree to be bound by these Terms of Use. If you do not agree, you are not authorized to use the platform.

 

1. Definitions

 

"CampusCloud," "we," "us," or "our" refers to the CampusCloud platform and its operators.

"User," "you," or "your" refers to any individual accessing or using the CampusCloud platform.

"Developer" refers to a student who has submitted an app or service to be listed on CampusCloud.

"App" or "Service" refers to any digital application, tool, or service available for download or use on the CampusCloud platform.

"Content" refers to all information, data, text, software, images, and other materials available on the platform, including Apps and Services.

 

2. Your CampusCloud Account

 

Account Responsibility: You are responsible for all activities that occur under your account. You agree to keep your password and other account credentials confidential and to notify us immediately of any unauthorized use of your account.

Accurate Information: You agree to provide and maintain accurate, current, and complete information during the registration process.

 

3. Use of the Platform

 

License to Use: CampusCloud grants you a limited, non-exclusive, non-transferable license to access and use the platform for your personal, non-commercial purposes, subject to these Terms of Use.

App Licensing: When you download or use an App from CampusCloud, you are entering into a separate agreement with the Developer of that App. CampusCloud is a third-party marketplace and is not a party to the license or terms between you and the Developer. You are responsible for reviewing and complying with any terms of use or privacy policy associated with each individual App.

Prohibited Activities: You agree not to engage in any of the following activities:

Using the platform for any illegal purpose or in violation of any local, state, national, or international law.

Infringing upon or violating the intellectual property rights of others, including the Developers of the Apps.

Attempting to gain unauthorized access to the platform, user accounts, or computer systems.

Distributing viruses, malware, or other malicious code.

Engaging in any form of harassment, spamming, or other abusive behavior.

Reverse-engineering, de-compiling, or otherwise attempting to derive the source code of any App or the platform itself.

 

4. Intellectual Property

 

Our Rights: All Content on the CampusCloud platform, including its design, text, graphics, and logos, is our property or the property of our licensors and is protected by copyright and other intellectual property laws.

Developer Rights: Developers retain ownership of all intellectual property rights in their respective Apps and Services. By submitting an App, the Developer grants us a limited license to host, display, and distribute the App on the CampusCloud platform.

 

5. Disclaimer of Warranties

 

CampusCloud provides the platform "as is" and "as available" without any warranties of any kind, whether express or implied. We do not warrant that the platform or any Apps will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the functionality, quality, or reliability of any App or Service listed on our marketplace. You use the platform and all Apps at your own risk.

 

6. Limitation of Liability

 

To the maximum extent permitted by law, CampusCloud will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform or any App, even if we have been advised of the possibility of such damages. Our total liability to you for any and all claims related to these Terms of Use or your use of the platform will not exceed the amount you have paid us, if any, in the last six months.

 

7. Indemnification

 

You agree to indemnify, defend, and hold harmless CampusCloud, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms of Use, or your infringement of any third-party rights.

 

8. Termination

 

We may terminate or suspend your account and access to the platform at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms of Use. You may terminate your account at any time by following the instructions on the platform.

 

9. Governing Law

 

These Terms of Use shall be governed by and construed in accordance with the laws of [Insert Governing Jurisdiction], without regard to its conflict of law provisions.

 

10. Changes to these Terms
